Rubbish Collection Soho Service Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Collection Soho provides rubbish and waste collection services to residential and commercial customers. By placing a booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before making a booking.

1. Definitions

In these Terms and Conditions, the following expressions shall have the meanings set out below:

Customer means any individual, business, company, partnership or organisation that requests or receives services from Rubbish Collection Soho.

Services means the rubbish collection, waste removal, clearance and related services provided by Rubbish Collection Soho as agreed with the Customer at the time of booking.

Waste means any items, materials or refuse presented by the Customer for collection and disposal as part of the Services, subject to the exclusions and restrictions set out in these Terms and Conditions.

Contract means the agreement between Rubbish Collection Soho and the Customer for the provision of Services, incorporating these Terms and Conditions and any specific terms agreed at the time of booking.

2. Scope of Services

Rubbish Collection Soho provides waste and rubbish collection services within its operating area, which may include regular collections, one-off clearances, and ad hoc waste removal. The precise nature and scope of the Services for each booking will be confirmed during the booking process.

Services may include labour for loading waste, transportation of waste, and lawful disposal or recycling of waste at licensed facilities. Any additional services, such as dismantling bulky items or extensive site clearance, must be agreed in advance and may incur extra charges.

Rubbish Collection Soho reserves the right to decline any job, or specific items within a job, at its discretion, including where it considers that a job may present health, safety, environmental or legal risks.

3. Booking Process

Bookings for Services may be made by telephone, email, online form or other communication channels made available by Rubbish Collection Soho from time to time. The Customer must provide accurate and complete information when making a booking, including:

1. The collection address and access details.

2. The type and approximate volume or weight of waste.

3. Any items that may be hazardous, restricted or require special handling.

4. The preferred date and time window for collection.

Following the Customer's request, Rubbish Collection Soho will provide an estimate or quotation for the Services, which may be based on the description and any images provided by the Customer. The estimate or quotation is not binding until confirmed by Rubbish Collection Soho.

A booking is deemed accepted, and a Contract formed, when Rubbish Collection Soho confirms the booking to the Customer by verbal confirmation, email, message or other written communication. Rubbish Collection Soho may amend or withdraw a quotation at any time prior to confirmation of the booking.

On arrival at the collection address, the team may reassess the waste volume, access conditions and any special requirements. If the actual circumstances differ from those described at the time of booking, Rubbish Collection Soho reserves the right to revise the price or decline part or all of the job.

4. Customer Responsibilities

The Customer is responsible for ensuring that:

1. They have the legal right and authority to request removal of the waste from the premises.

2. Access to the premises is safe, lawful and adequate for the Services to be carried out, including suitable parking and loading areas where reasonably possible.

3. Waste to be collected is clearly identified and separated where necessary, and that any items not intended for removal are clearly indicated.

4. Any hazardous or restricted waste to be collected is fully disclosed to Rubbish Collection Soho in advance, with sufficient information for safe handling and legal compliance.

5. The Customer, or an authorised representative, is present at the time of collection unless otherwise agreed in writing.

The Customer shall indemnify Rubbish Collection Soho for any loss, damage, liability, costs or expenses arising from the Customer's breach of this clause or any other provision of these Terms and Conditions.

5. Pricing and Payments

Prices for Services are usually based on factors including, but not limited to, the type and volume of waste, weight, labour required, access conditions and distance to disposal facilities. Any price provided prior to inspection is an estimate only and may be adjusted on site if the actual waste, conditions or requirements differ from those described by the Customer.

Rubbish Collection Soho will notify the Customer of any change in price before commencing the work. If the Customer does not agree to the revised price, Rubbish Collection Soho may cancel the job, and the Customer may be liable for a call-out or cancellation fee where applicable.

Unless otherwise agreed in writing, payment is due on completion of the Services on the day of collection. Rubbish Collection Soho accepts payment methods as communicated to the Customer, which may include cash, card payments, bank transfer or other electronic methods.

For account customers or commercial customers with agreed terms, invoices shall be payable within the timeframe specified on the invoice or in any separate written agreement. If no timeframe is stated, invoices shall be payable within 14 days of the invoice date.

Rubbish Collection Soho reserves the right to charge interest on overdue amounts at the statutory rate permitted under applicable UK law, together with any reasonable costs of debt recovery.

6. Cancellations, Amendments and Access

The Customer may cancel or amend a booking by contacting Rubbish Collection Soho as soon as reasonably practicable. Rubbish Collection Soho will use reasonable efforts to accommodate changes, but cannot guarantee availability for alternative dates or times.

If the Customer cancels less than 24 hours before the agreed collection time or fails to provide access when the team arrives, Rubbish Collection Soho reserves the right to charge a cancellation or call-out fee to cover time and transport costs.

Rubbish Collection Soho may cancel or reschedule a booking due to circumstances beyond its reasonable control, including but not limited to severe weather, traffic disruption, vehicle breakdown, staff illness, safety concerns or legal restrictions. In such cases, Rubbish Collection Soho will notify the Customer as soon as reasonably practicable and offer an alternative date or a refund of any pre-paid amounts for Services not provided.

If Rubbish Collection Soho is unable to gain safe or lawful access to the premises, or if the waste is not as described and presents safety, environmental or legal concerns, the company may refuse to carry out the Services. In such cases, a cancellation or call-out fee may apply.

7. Waste Types and Regulations

Rubbish Collection Soho operates in compliance with applicable UK laws and regulations governing waste management, including the duty of care with regard to the storage, transport and disposal of waste. All collected waste will be transported to authorised facilities for disposal, treatment or recycling wherever reasonably practicable.

The Customer must not present for collection any waste that is prohibited or controlled under applicable legislation without prior written agreement. Such waste includes, but is not limited to:

1. Hazardous or special waste, such as certain chemicals, solvents, asbestos, clinical waste, radioactive materials and some electrical equipment.

2. Pressurised containers, gas bottles and certain flammable or explosive materials.

3. Liquid waste not securely contained and suitable for transport.

4. Any waste for which the Customer does not have legal authority to dispose.

If prohibited or undeclared hazardous waste is discovered, Rubbish Collection Soho may refuse to handle it, may require additional fees for safe handling and may report any suspected illegal activities to the relevant authorities.

The Customer acknowledges their responsibility to provide accurate information about the nature and source of the waste. Rubbish Collection Soho is entitled to rely on the Customer's information when classifying waste and selecting appropriate disposal routes, but may inspect waste and make its own assessment if necessary.

8. Liability and Limitations

Rubbish Collection Soho will exercise reasonable care and skill in providing the Services. However, the company shall not be liable for any loss, damage, costs or expenses arising from:

1. Circumstances beyond its reasonable control.

2. Inaccurate or incomplete information provided by the Customer.

3. Actions or omissions of the Customer or any third party.

4. Pre-existing structural defects, wear and tear, or inherent risks associated with moving heavy items in confined or delicate spaces.

Rubbish Collection Soho will take reasonable steps to avoid damage when removing items, but the Customer is responsible for protecting floors, walls, fixtures and fittings where necessary, and for removing any fragile or valuable items from areas where work is to be carried out.

Except in respect of death or personal injury caused by negligence, fraud or any other liability that cannot be excluded or limited by law, the total liability of Rubbish Collection Soho in respect of any claim arising under or in connection with the Contract shall be limited to the total price paid or payable by the Customer for the specific Services to which the claim relates.

Rubbish Collection Soho shall not be liable for any indirect or consequential loss, including loss of profit, revenue, business, opportunity, or any loss arising from delay, where such delay is not solely and directly caused by the company's negligence.

9. Customer Property and Abandoned Items

The Customer is responsible for ensuring that any items presenting for removal are intended for disposal. Rubbish Collection Soho cannot accept liability for items taken away in error where those items were not clearly separated or identified as not for removal.

Once items have been removed and loaded onto a vehicle, they will usually be mixed with other waste and cannot be retrieved. The Customer must check carefully before the team departs that no items of value or importance have been removed in error.

If items are left on the premises due to safety concerns, access issues or non-payment, the Customer will remain responsible for them and for any associated risks or costs.

10. Data Protection and Privacy

Rubbish Collection Soho may collect and process personal data about Customers for the purposes of managing bookings, delivering Services, processing payments, handling complaints and meeting legal obligations. Such data may include contact details, service addresses, payment information and any communications between the Customer and the company.

Personal data will be handled in accordance with applicable UK data protection legislation. Rubbish Collection Soho will take reasonable steps to protect personal data from unauthorised access, loss or misuse and will only retain data for as long as necessary for the purposes for which it was collected or as required by law.

11. Complaints and Dispute Resolution

If the Customer is dissatisfied with any aspect of the Services, they should contact Rubbish Collection Soho as soon as reasonably practicable, providing details of the issue and any relevant evidence. The company will investigate and seek to resolve complaints in a fair and timely manner.

Where appropriate, Rubbish Collection Soho may offer a partial refund, re-attendance or other remedy, at its discretion and subject to the circumstances of the case. This does not affect the Customer's statutory rights under UK law.

12. Variations to Terms

Rubbish Collection Soho may update or amend these Terms and Conditions from time to time. The latest version will apply to all new bookings made after the date of publication or notification. For ongoing contracts or regular collections, Rubbish Collection Soho will notify Customers of any material changes where reasonably practicable.

No variation to these Terms and Conditions shall be valid unless agreed in writing by an authorised representative of Rubbish Collection Soho. Any terms or conditions proposed by the Customer that are inconsistent with these Terms and Conditions shall be of no effect, unless expressly accepted in writing.

13. Severability

If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, illegal or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.

14. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter or formation.

15. Entire Agreement

These Terms and Conditions, together with any written confirmation of booking and any agreed written variations, constitute the entire agreement between Rubbish Collection Soho and the Customer in relation to the Services, and supersede all prior discussions, correspondence, negotiations or understandings between them relating to the same subject matter.

By placing a booking or using the Services, the Customer acknowledges that they have read, understood and agree to be bound by these Terms and Conditions.
